Terms and conditions of occupancy for halls of residence 2026-2027

These terms and conditions apply for students staying in:

This agreement is legally binding. Please read it carefully. Any changes to the terms and conditions of this contract can only be made with written approval from Student Accommodation Services.

This contract and the Offer of Accommodation, when you confirm acceptance of the Offer of Accommodation by providing your student ID and Date of Birth electronically, form a legally binding obligation between You and the University; so please read all documents very carefully and make sure you understand and agree to them before you make a commitment.

This is a Student Let Agreement within the meaning of paragraph 5 of schedule 1 to the Private Housing (Tenancies) Scotland Act 2016. The purpose of this agreement is to confer on student named in the Offer of Accommodation the right to occupy the Premises while the named person is a student. The student named in the Offer of Accommodation in entering into this contract acknowledges that nothing contained within this contract is to be construed as conferring on the named person a Private Residential Tenancy. 

Licence Agreement between

1. The University of 58勛圖, through its Student Accommodation Services at Walter Bower House, Eden Campus, Guardbridge, 58勛圖, Fife, KY16 0US, is a registered Scottish Charity (Charity Number SC013532) and is referred to as ‘the University’ in this agreement.

And

2. The student named in the Offer of Accommodation, enrolled in a full-time course at the University, will be referred to as ‘You’ throughout this contract (and ‘Your’ will be construed accordingly).

Whereas

The University has made an Offer of Accommodation to You which You have accepted.

Therefore

The University agrees to provide you with the accommodation (‘the Premises’) for the agreed period (‘Period of Licence’) at the rent stated in your Offer of Accommodation, under the terms and conditions in this contract.

Definitions and Interpretation

  • ‘the Offer of Accommodation’ is the Offer of Accommodation made by the University to You and Your acceptance of it.
  • ‘Period of Licence’ means the time you are allowed to stay in the accommodation, as stated in your Offer of Accommodation.
  • ‘Premises’ means the room offered to You (single, twin, or triple) as stated in Your Offer of Accommodation. It also includes access to shared areas such as kitchens, lounges, corridors, and stairwells within or around the Residence.
  • ‘the Rent’ is the Residence fees due by You as detailed in the Offer of Accommodation.
  • ‘Residence’ is the building which the Premises form part of.
  • ‘Residential Services Management’ is the team of staff who operate the Residence including managers, administrative staff, porters and housekeeping staff based at Walter Bower House, Eden Campus, Guardbridge, 58勛圖, Fife, KY16 0US or such other department of the University authorised and instructed to act on behalf of the University in connection with operation of the Residence.
  • ‘Saint Sport’ is responsible for managing all sport and fitness related activities, services and facilities at the University of 58勛圖 and is a partnership between the Department of Sport and Exercise and the Athletic Union based at University Park, St Leonards Road 58勛圖 KY16 9DY.
  • ‘Wardennial Team’ is the team of staff who provide pastoral support, and a positive and supportive experience in the University residences or such other department of the University authorised and instructed to act on behalf of the University in connection with provision of such a service.

Unless set out to the contrary in this contract, all terms used in this contract shall have the same meanings given to them in the Offer of Accommodation.

1 This contract

1.1 The University may outsource or delegate any of its responsibilities under this agreement to a third party (called the ‘Manager’) without needing your consent. These responsibilities will be referred to as ‘Outsourced Matters’.

1.2 You agree to live in the accommodation in line with the following rules:

  • This contract
  • The University’s rules and policies, including Sponsio Academica, Honour Code, Student Conduct Risk Management Policy, and Student Conduct Policy (the terms of which can be found Rules and regulations | Current Students | University of 58勛圖)
  • Any accommodation-specific rules provided to You

Breaking these rules may affect future accommodation applications. The University may require You to move to another residence immediately if Your behaviour breaches these rules.

2 Arrival

2.1 Your Premises are available from 10am on the start date of your contract, unless the University tells You otherwise. For details, see the Arriving at your accommodation guide.

2.2 If You need accommodation before this contract starts, contact Student Accommodation Services as soon as possible. Extra nights depend on availability and will incur additional charges (see Staying in University accommodation during vacations guide).

3 Inventory

3.1 Shortly after You arrive, You will receive inventory forms for the Premises. Check them carefully, then sign and return them to the Manager within 48 hours.

3.2 If You don’t receive an inventory, ask for one. Record any damage or missing items and return the signed form within 48 hours. If You don’t, we’ll assume everything is in good condition. You’ll be charged for any damage or loss found later.

4 Offer and Period of Licence

4.1 Your Offer of Accommodation and the quoted rent are valid until the date shown in the offer. After that, the offer expires. If You don’t accept it by then, the University may not make another offer and could change the terms in any future offer.

4.2 This contract is for a fixed period. You must pay the full rent (and catering costs if applicable) for the entire Period of Licence, unless clause 9 applies.

4.3 If You have not matriculated and moved into the Premises by the end of week five, You will only be charged up to the date we receive confirmation from Your faculty that You failed to matriculate.

5 Cancellation

5.1 If You cancel after accepting the Offer of Accommodation but before moving in and remain a matriculated student, You must still pay the full rent (and catering costs if applicable) for the entire Period of Licence.

5.2 If You leave before Your contract ends but remain a matriculated student, You must still pay the full rent (and catering costs if applicable) for the entire Period of Licence.

5.3 If Your course requires You to study away from 58勛圖, You can end this contract by giving at least 28 days’ written notice and providing confirmation from Your faculty. If the University moves students due to government restrictions or other exceptional events (force majeure), You can also end this contract with 28 days’ written notice.

5.4 Global Merit Award - Your Offer of Accommodation depends on meeting the Global Merit Award (as defined in Your University Offer) study conditions by 31 July of Your entry year. If You don’t meet these conditions by that date, this contract will automatically end.

6 Room Changes

6.1 The University may change the Offer of Accommodation and move You to another suitable residence, even after the Offer of Accommodation is confirmed or during the Period of Licence.

6.2 If You remain in sole occupancy of a shared room, you must pay the single-room rate for the rest of the Period of Licence or until another student is assigned to the shared room. Student Accommodation Services may allocate the vacancy to a suitable student. If You cannot pay the single-room rate, You may need to move to another shared room.

6.3 If a room becomes vacant in a flat or cluster, Student Accommodation Services can offer it to another suitable student during the Period of Licence.

7 Payment

7.1 If You do not pay the Rent, You will not receive any further accommodation offers while the debt remains. Before You can apply for University accommodation again, You must agree a repayment plan with the University’s Finance Department. If You miss payments on this plan, a late fee will apply. Information about payment options is available on the Undergraduate or Postgraduate fee guide.

7.2 Please note that any student with an outstanding debt to the University may not be permitted to graduate. This includes, but is not limited to, sponsor’s debts (which will be transferred to Your account), tuition fees, residential and telephone charges, and library fines.

7.3 Hall Subscriptions, where applicable, are collected within the Rent, then issued to Your hall committee in Semester 1. Once allocated to the hall committee, all hall subscriptions are non-refundable.

8 Code of Conduct

8.1 You must follow the University’s rules and codes of practice, including the Sponsio Academica, Honour Code, Student Conduct Risk Management Policy, Student Conduct Policy, and the Residents’ Guide. You are also responsible for the behaviour of Your visitors and guests anywhere on University property.

8.2 If You break these terms or any University rules, You may face disciplinary action. This can include being removed from the Premises, moved to alternative University accommodation and permanently banned from University accommodation.

8.3 University staff, including the Director of Residential and Business Services, Residential Services Management, and the Wardennial Team, can take disciplinary action if Your behaviour is in any way prejudicial to the good order and smooth running of the Residence or causes disruption in the Residence. They can also apply risk management measures under University policies, such as the Student Conduct Risk Management Policy and Student Conduct Policy. This may include moving You to another University residence or excluding You from University accommodation.

8.4 The Student Conduct Risk Management Policy and the Student Conduct Policy, or any amendments to the Policies, will be used to deal with all other disciplinary matters.

9 Removal from University Accommodation

9.1 If this contract is ended and You are removed from the Premises, the University may still take further action if needed. The University will not pay You any compensation.

9.2 If this contract ends and You are removed from the Premises, You must still pay all the Rent and other charges (including catering fees if applicable) until the end of the semester in which You leave.
This contract will normally run until the end of the Period of Licence. It can only end early if one of the following events happens. If it does, this contract will end five days after the University tells You to leave (or another period set by the University).

9.2.1 You are taking a leave of absence from Your studies;

9.2.2 You have had Your studies terminated or suspended;

9.2.3 You have been placed on a compulsory or mandatory Leave of Absence;

9.2.4 You withdraw from the University;

9.2.5 You have missed the University’s matriculation deadline and have not moved into the Premises within five weeks of this contract’s start date.

9.2.6 If You are referred for risk assessment under the Student Conduct Risk Management Policy for alleged non-academic misconduct, the University may apply risk measures. These can include removing You from the Premises or moving You to alternative University accommodation.

9.2.7 If you are the subject of formal disciplinary action under the Student Conduct Policy, the University may apply outcomes which may include removing You from Your current accommodation or moving You to alternative University accommodation

9.2.8 You have not paid the Rent or any other amount owed by the due date, unless You have an agreed payment plan with the University.

9.2.9 You break any of the rules or fail to meet the responsibilities set out in this contract.

9.2.10 You behave in any way prejudicial to the good order and smooth running of the Residence in which You reside.

9.3 Once You are told to leave the Premises, You must email Student Accommodation Services right away from Your University email account to arrange the details. Use this address: accommodation@st-andrews.ac.uk.

9.4 If the University believes that Your continued presence may have a detrimental effect on an individual or individuals within any Residence or on the community or staff as a whole prior to removal and termination of this contract, the University reserves the right to move You to suitable alternative accommodation until such date of termination.

9.5 If You give birth or adopt a child and the Premises is for single occupancy, You will need to vacate the Premises. The University cannot guarantee that suitable family accommodation will be available.

9.6 If You are removed from one University residence, You may be banned from living in any other University accommodation for the rest of the academic year or longer, if the University decides.

10 Your Conduct

You must ensure that You (or Your guests or visitors) do not:

10.1.1 Bring illegal drugs into Your Residence or misuse drugs in any part of the Premises or the University’s property;

10.1.2 Cause other occupants of University Residences or any other person any injury, disturbance, disruption, distress, annoyance, nuisance, harassment, inconvenience or damage to their property;

10.1.3 act in a way that puts others at risk, disrupts the Residence, or damages the University’s reputation. This includes damaging property, behaving antisocially, or causing problems due to excessive alcohol or drug use. If Your behaviour harms others, You may face disciplinary action and possibly legal consequences.

10.1.4 Cause any excessive or unnecessary noise in the Residence;

10.1.5 Permit others to occupy the Premises without the permission of the University;

10.1.6 You must not bring firearms, weapons, or anything dangerous onto University property. This includes replicas or parts of weapons.

10.1.7 Hang banners, flags, or similar materials in windows or on the outside of the Residence.

10.2 If You choose alcohol-free accommodation, You agree not to drink alcohol there. If You do, You will get a first and final warning. If it happens again, the University will move You to another residence. You are also responsible for making sure Your guests follow this rule.

10.3 University staff can confiscate any item they believe could harm safety or disrupt order. They can also fine You or require You to pay for any damage. This does not affect other actions the University may take regarding Your conduct.

10.4 You are not permitted to use recording devices, including CCTV, video doorbells or similar technology, to capture imagery or sound of others without their knowledge and consent within University accommodation.

11 Your obligations in connection with the Premises

You must ensure that You (and, where applicable, Your guests or visitors):

11.1 The Premises are for living and studying only. You must not run a business from the Premises. Fundraising for good causes is usually allowed with prior approval from Residential and Business Services. If You want to do consultancy work under University arrangements, see the Consultancy Policy.

11.2 Do not change or damage the decorative finish of the Premises or any other part of the Residence;

11.3 Do not damage or remove University furniture from the Premises or the Residence. At the end of this contract, all furniture must be back in its original position. You will have to pay for any damage caused by moving furniture or attaching items to walls.

11.4 Keep Your room key or keycard with You at all times. If You lose it or get locked out, You may have to pay a fee.

11.5 You must pay for any damage or loss caused by You or Your guests. This includes damage to the Premises, extra cleaning, or costs linked to collecting unpaid fees. If repair costs are higher than replacement, the University may replace the item instead.  Report any damage or loss to the Residential Services Management within 24 hours.

12  Your obligations in connection with Common Parts and Shared Facilities

You must ensure that You (and, where applicable, Your guests or visitors):

12.1 Work with other residents to keep shared areas—like kitchens, bathrooms, corridors, and stairwells—clean and tidy. Do not let rubbish build up.

12.2 Keep shared areas and utensils clean. If they become unhygienic and pose a health risk, staff can remove and dispose of items after giving You notice.

12.3 You must pay for any damage or loss caused by You or Your guests. This includes damage to the shared areas of the Residence, extra cleaning, or costs linked to collecting unpaid fees. If repair costs are higher than replacement, the University may replace the item instead. Report any damage or loss to the Residential Services Management within 24 hours.

12.4 The person who has caused the damage to the shared areas of the Residence will pay the cost of the damage. In the event that it cannot be ascertained who has caused the damage, each occupant will be jointly and severally liable for the cost of repair of the damage, including replacements where necessary.

13 Our Obligations

13.1 The University will provide the facilities and services listed in this contract. It is not responsible for any interruptions or losses caused by You, other students, or events beyond its control.

13.2 When You pay the Rent, the University will ensure that You become a beneficiary of the University of 58勛圖 Halls of Residence Block Insurance Policy. This provides You with basic insurance cover for Your possessions and, in certain circumstances (and to a set limit), the Premises. Information leaflets giving details of the cover will be provided by the insurance company to the Residence. You will be responsible for making any claims.

14 Sports Equipment

14.1 Some sports equipment, like archery gear, fencing foils, or ice axes, can be considered weapons. You must get permission before bringing these into the Residence. First, contact Residential Services Management. Saints Sport must confirm You use the equipment as part of an official University club. If You are unsure whether an item counts as a weapon, ask the Wardennial Team or Residential Services Management.  Saint Sport may also provide advice on appropriate storage of these items.

15 Health and Safety

You must not:

15.1 Allow Your health or behaviour, in the reasonable opinion of the University, to constitute a serious risk to You or others, or the University’s or other people’s property.

15.2 Bring pets or any living animals (except for guide dogs and hearing dogs) onto or keep at any of the University’s Residences;

15.3 Do not bring Your own furniture, curtains, lampshades, floor lamps, or halogen lamps, since all furnishings must comply with relevant safety legislation;

15.4 Do not block shared areas like kitchens, bathrooms, or hallways. Keep access routes to the Premises clear at all times.

15.5 Put anything harmful or which is likely to cause blockage in any pipes or drains, this includes (but is not limited to) wipes, paper towels, blue roll, sanitary products;

15.6 Throw or drop anything whatsoever from windows or balconies of any University Residence;

15.7 Allow anyone into the Residence unless You are satisfied that the person is a resident, a guest of a resident, or is there with the University’s authority.

You must:

15.8 Have regard to the safety and security of the Premises and You must ensure that You (and, where applicable, Your guests or visitors):

15.8.1 Keep You’re the Premises clean and tidy at all times and hand it over to the University upon early termination or expiry of this contract in a tidy, clean and good condition;

15.8.2 Immediately report to the Residential Services Management team or the Manager any faults or repairs required to the Premises or to the fittings and furniture in accordance with the inventory prepared in terms of clause 3.

15.8.3 If You lose a key or electronic access device, tell the Residential Services Management or Wardennial Team right away. You will have to pay the replacement cost.

15.9 Keep Your doors and windows locked when You are not in the Premises;

15.10 When entering and leaving the Residence ensure that the main entrance door is shut and locked behind You;

15.11 Allow the University upon reasonable notice and at reasonable times (save in case of emergency when no notice is needed) to enter the Premises to clean and undertake inspections or repairs or for any other reasonable purpose;

15.12 If asked by University staff, show proof You live there, like Your student ID card.

15.13 If the Premises have a sink, shower, or toilet, run the taps/shower for five minutes and flush the toilet at least once every week. In kitchens, run the taps for five minutes weekly.

16 Fire and Electrical Safety

16.1 The University is not responsible for damage or injury caused by Your electrical equipment. You are fully responsible for using it safely. At the start of the semester, the University will test and certify Your equipment. Anything brought later must be tested at Your expense. Ask your Residential Services Management for safety advice.  Any items found not to be tested will be removed.  

16.2 Do not bring kitchen or cooking appliances, adaptors or power leads from outside the UK—they may not meet safety standards. You can bring laptops, phones, and tablets, but they must pass the University’s safety check and use UK power cables bought in the UK. 

16.3 Do not use high-powered electrical items, irons, or any cooking equipment (like air fryers, multi-cookers, rice cookers or kettles) in bedrooms. Store all cooking equipment in the kitchen or pantry.

16.4 Do not bring extra hobs, fridges, freezers, microwaves, deep fat fryers, electric blankets, or any electrical items from outside the UK. The following are strictly banned: fireworks, electric heaters, paraffin heaters, halogen heaters, and gas heaters. You can use small kitchen appliances bought in the UK (see the approved list for your accommodation). They must pass a Portable Appliance Test (PAT) for safety. Because kitchen space is limited, buy these items after You arrive. Ask your Residential Services Management for safety advice.

16.5 Do not tamper with wiring or overload sockets with too many appliances. Your electrical items, including cables, must be UK-compliant and in good condition. Never cover chargers or power adapters.  

16.6 The Wardennial Team or Residential Services Management has the right to refuse the use of (and, if necessary, remove from the bedroom and or Residence) any piece of electrical equipment within the Residence if they judge it to breach Health and Safety Regulations or be prejudicial to the good order and safety of other residents.

16.7 Do not abuse the fire alarm or associated safety systems and equipment; do not cover smoke detectors.

16.8 Comply with all compulsory fire training arranged for the Residence at the start of the academic year.

16.9 Only use fire exits in an emergency and keep fire routes clear of obstructions at all times.

16.10 Do not use candles, naked flames, decorative rope lights (except battery operated or LED lights) or joss sticks, or do anything else that may constitute a fire hazard.

16.11 If You set off a fire alarm without cause, the University must report it to the Police. Giving a false fire alarm is a crime under the Fire (Scotland) Act 2005 and can lead to a fine, prison, or both. 

17 Non-Smoking Policy in Residences

17.1 Smoking is not allowed anywhere in the Residence, including entrances and covered areas. This rule also applies to e-cigarettes. You must make sure Your guests follow this rule. If You or Your guests smoke, or if there is evidence that smoking has happened, You will face disciplinary action.

18 Guests

18.1 If You share a room in the Premises, You can only have guests if Your roommate agrees. You must tell the Residential Services Management or the Wardennial Team, or sign the guest book for any overnight guest. This is important so everyone can be accounted for in case of a fire. 

18.2 You can have a guest for up to three days in one week, and no more than twice in any four-week period. All other occupants must agree. If the same person stays longer or keeps coming back, it counts as a permanent arrangement and breaches the terms of occupancy. This may lead to disciplinary action. The University is not responsible for Your guests or their belongings—You are responsible for their behaviour. 

18.3 University staff or anyone authorised by the University can refuse entry to any guest or visitor. The University can also refuse entry to guests who arrive without a resident. 

18.4 Overnight guests are not permitted to stay in the accommodation during arrivals weekends and orientation weeks.

19 Prohibition on Sub-Letting or Assigning Rooms

19.1 You cannot sublet the Premises, share it, or give it to someone else. Your right to live in the Premises cannot be transferred to anyone.

20 Privacy of Residents

20.1 Your privacy will be respected whenever possible. Normally, You will get 24 hours’ notice before a visit, except for routine checks by managers, wardens, duty staff, or housekeeping. The University can enter the Premises at reasonable times for official duties. 

20.2 Housekeeping will check all rooms and shared areas once a month. You will get advance notice of the inspection. If the Premises don’t meet the required standards, You will be given time to fix the issues. If things are still not fixed after a re-check, the Residence Management Team will organise the work and charge the cost to You and the other occupants.

20.3 An annual Health and Safety inspection is conducted in all properties.

21 Loss and Damage to Property

21.1 The University is not responsible for any loss or damage to cars, motorbikes, bicycles, or similar vehicles parked on University property.

22 When You Leave

22.1 When this contract ends and You move out, You must:

  • Leave all University items listed in the inventory.
  • Remove all Your personal belongings.
  • Leave the Premises clean and in good condition.
  • Return all keys and access cards to the Residence Management Team.

The University may check access logs to confirm Your departure. If You don’t return keys or cards, or if there is damage or missing items, You will be charged for replacements and repairs. You may also be charged for any losses caused by late return of keys or cards.

22.2 If You leave any furniture or personal items when You move out, they will be treated as rubbish and disposed of immediately. The University will not be responsible for any loss. You will be charged for any reasonable costs and admin fees for clearing and disposing of Your belongings. 

22.3 The University will not forward correspondence received once You have vacated the accommodation.

23 Bicycles

23.1 Do not keep bicycles in the Premises or anywhere inside the Residence. Use the designated bike storage area for your Residence.

23.2 This rule also applies to mopeds, scooters, and similar transport items.

23.3 E-bikes/scooters are not permitted in Residences and it is not permitted to charge these batteries in Residences.

24 Complaints Procedure

24.1 If You have a complaint, first speak to Residential Services Management. For formal complaints about the Premises or this contract, follow the University Complaints Handling Procedure.

25 Disclaimer

25.1 Subject to the provisions of the Occupiers Liability (Scotland) Act 1960 the University shall not in any circumstances incur any liability in respect of loss or damage to any person, property or otherwise unless the damage is proven to be caused by the University’s negligence.

26 Communication

26.1 If You need to communicate about this contract, it must be in writing. You can deliver it by hand, send it from Your University email, or post it by first-class mail to Student Accommodation Services (address in your Offer of Accommodation email).
The University will send communications to You by hand, by email to Your University account, or by first-class mail to the Premises.

27 Data Protection

27.1 The information held on Your accommodation application form and in any other records or correspondence relating to the Premises are stored as part of Your records on a database and as manual records. This data is held and processed in accordance with the requirements of the Data Protection Act 2018, and the University’s Terms and Conditions of Occupancy and Code of Practice. For further information regarding the use and distribution of students’ personal information, please see the University Data Protection Code - Students. You hereby authorise the University to use Your personal data for all lawful purposes in connection with this contract (including debt recovery and crime prevention) or where there is a serious risk of harm to You or to others or to the University’s property.

28 Invalidity

28.1 If any provision of this contract is ruled invalid by any competent court or unenforceable in whole or part, then this shall not affect the validity of the other provisions of this contract.

29 Waiver

29.1 Failure or delay by the University to enforce any provision of this contract is not to be considered a waiver of any subsequent breach of the same or any other provision of this contract.

30 Governing Law

30.1 Exclusively Scottish law and jurisdiction govern this contract which, for international students, may be different to the laws in Your own country. You should make sure You read and understand these Terms and Conditions of Occupancy before accepting Your Offer of Accommodation letter or this contract.
